Welcome to Minibar! These Terms and Conditions set out the rules under which you are allowed to use the Minibar App and its services, including the browsing, purchase, and delivery of alcoholic beverages from our website, mobile application, or other platforms. By accessing or using Minibar, you confirm that you have read, understood, and agreed to these Terms.

If you disagree with any of these, do not use our services.

1. Eligibility

Minibar can only be used by persons who are 21 years old or more. When you make an order, you give us your word that:
You are 21 years old or more.
You will show the person who delivers the order a valid ID issued by the government.
You have legal permission to buy alcohol and receive it in your jurisdiction.
We also reserve the right to refuse or cancel an order in case of underage or any other issue related to the fulfillment of the order that is found.

2. How It Works

The users are connected by Minibar with licensed local retailers who can give them delivery service of alcoholic beverages. Placing an order is:
Minibar acts as a facilitator and technology platform.
The delivery can be done by the retailer, a third-party delivery service, or Minibar-approved delivery personnel.

3. Alcohol Delivery Rules

The person who receives the alcohol must be there when it is delivered.
Showing ID is necessary.
ID must contain the same spelling that was used in the order.
Alcohol cannot be left alone or given to a person who is drunk.
Non-adherence to these regulations will lead to an undelivered order and also additional charges might be incurred.

4. Pricing, Payments, and Fees

Unless otherwise mentioned, prices shown are in USD and are inclusive of taxes.
At the time of checkout, any extra charges that you incur will be made clear to you.

5. Cancellations and Refunds

Orders can be canceled within a limited time window after placement. After that, cancellations may not be accepted.
Refunds are only issued in accordance with our Refund Policy (available in-app or online).
If a delivery cannot be completed due to age verification failure, no refund will be issued.

6. Prohibited Conduct

You agree not to:

Use the app for illegal purposes or in a way that is not in compliance with local alcohol laws.
Misrepresent yourself or impersonate someone else.
Try to figure out the source code or use the platform in a way that was not intended. Commit offensive, harassing acts or injury against a delivery person or retailer.

A violation of these terms of use may result in Minibar closing your account without prior notice.

7. Account and Security

You are the only person responsible for the secrecy of your account and the characters that make up your password. In the event of any unauthorized use of your account, you undertake to inform us immediately. Minibar shall not be liable for any loss or damage resulting from unauthorized access to your account.

8. Disclaimers and Limitation of Liability

Minibar offers services based on “as is” and “as available.” We make no representations that the services will be continuous, safe, or free from errors. Minibar, its affiliates, and partners shall not be fully responsible for any of the following permitted by law: Any indirect, incidental, or consequential damages; Death or personal injury resulting from the incorrect use of alcohol; Mistakes in order fulfillment caused by third-party retailers or couriers.

9. Indemnification

You undertake to indemnify and hold harmless Minibar, its employees, directors, and partners from any claims, losses, damages, liabilities, or expenses that may occur because of your: Use of the Services; Violation of these Terms; Violation of Privacy.

10. Privacy

By using Minibar, you agree to our Privacy Policy, which details how we obtain, utilize, and secure your personal data.

11. Changes

Minibar can change these Terms from time to time. If significant changes are made, we will inform you by email or app notification. Continued use of the app after changes indicates your acceptance.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the land, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of the Services will be resolved:

Through binding arbitration in West Bengal
In the appropriate courts of India if arbitration is not applicable.
